1. About FoundHer

FoundHer provides business strategy, marketing, consulting, education, mentorship and related services designed to help women build and grow their businesses.

The specific services, deliverables, timelines and fees applicable to you will be outlined in the relevant proposal, quotation, programme description or service agreement.

 
2. Our Services
 

We aim to provide all services professionally, with reasonable care and in accordance with the agreed scope.

Where a service includes specific deliverables, revisions, meetings, content creation or support, these will be limited to what is included in the agreed package unless otherwise agreed in writing.

Additional work outside the agreed scope may be quoted and charged separately.
 
3. Client Responsibilities
 

To allow us to deliver our services effectively, clients are responsible for providing accurate information, necessary account access, content, approvals, feedback and other requested materials within reasonable timeframes.

Delays in receiving information, feedback or approvals may affect agreed delivery dates.
 
4. Payments
 

Fees and payment terms will be communicated before services begin.

Unless otherwise agreed in writing, payment must be made according to the payment schedule stated on your invoice, quotation or service agreement.

FoundHer reserves the right to pause work or withhold deliverables where payments are overdue.

Any third-party costs, including advertising spend, software subscriptions, printing, website hosting or other external services, are separate from FoundHer's professional fees unless specifically stated otherwise.
 
5. Cancellations & Refunds
 

Because our services often involve strategy, planning, preparation and reserved capacity, payments for work already completed are non-refundable.

Cancellation terms for ongoing retainers, programmes or packages will be specified in the relevant service agreement or proposal.
 

Where no separate cancellation terms have been agreed, reasonable written notice must be provided before cancelling an ongoing service.
 
6. Marketing & Business Results
 

We work to provide thoughtful strategy, quality execution and commercially focused recommendations; however, FoundHer does not guarantee specific business, revenue, sales, follower, lead or advertising results.

Business and marketing performance can be influenced by factors outside our control, including market conditions, customer behaviour, budgets, platforms, competition, pricing and the client's implementation of recommendations.

Any examples, projections, case studies or previous results are provided for illustration and do not guarantee future performance.
 
7. Advertising Platforms & Third-Party Services
 

Where our services involve platforms such as Meta, Google, email marketing providers, website platforms or other third-party services, those platforms operate under their own terms and policies.

FoundHer is not responsible for platform outages, algorithm changes, account restrictions, suspensions, policy changes or other circumstances outside our reasonable control.
 
8. Content & Approvals
 

Where FoundHer creates content, advertisements, designs or other materials for a client, the client is responsible for reviewing and approving the final material before publication where approval has been requested.

The client is responsible for ensuring that information supplied to FoundHer, including claims about products or services, is accurate and lawful.
 
9. Intellectual Property
 

FoundHer retains ownership of its original frameworks, methodologies, templates, training materials, programme content and other proprietary resources unless otherwise agreed in writing.

Once full payment has been received, clients may use final client-specific deliverables created for their business in accordance with the agreed service.

FoundHer materials may not be copied, resold, reproduced, distributed or presented as another person's or business's work without written permission.
 
10. Confidentiality
 

We respect the confidential information shared with us by our clients and will take reasonable steps to protect it.

Clients are similarly expected to respect FoundHer's confidential business information, methodologies, resources and materials.
 
11. Testimonials & Portfolio Use
 

We will not publish confidential client information.

Where we wish to use identifiable client work, testimonials, results or case studies for marketing purposes, we may request the client's permission where appropriate.
 
12. Limitation of Liability
 

To the extent permitted by South African law, FoundHer will not be liable for indirect or consequential losses arising from the use of our website, programmes, recommendations or services.

Nothing in these Terms is intended to exclude any rights or protections that cannot lawfully be excluded under applicable South African law.
 
13. Privacy
 

Personal information is processed in accordance with our Privacy Policy and applicable South African data protection legislation, including the Protection of Personal Information Act (POPIA).
 
14. Changes to These Terms
 

We may update these Terms & Conditions from time to time. The latest version will be published on our website with the date of the most recent update.
 
15. Governing Law
 

These Terms & Conditions are governed by the laws of the Republic of South Africa.
